Terms of use Kanban

End User License Agreement (EULA)

This EULA is an agreement between the end user ("Customer") and Itecube, a company based in France ("Itecube"), for the application PipeCockpit or Free Kanban (the "Product/Service"). By subscribing to or using the Product/Service, the Customer agrees to be bound by this EULA. If you do not agree, you may not use the Product/Service.

1. Grant of License

Itecube grants a non-exclusive, non-transferable license to use PipeCockpit, subject to Customer's compliance with payment and Microsoft Dynamics 365 requirements. Free Kanban is provided without the need for a license.

2. Ordering and Subscription

The Customer must place an order for each subscription to PipeCockpit, which will include the term duration and the number of authorized users. Subscription fees are non-refundable and subject to change.

3. Limited Data Collection

Itecube may collect personal information such as name, email, or phone number for licensing purposes. Customer has the right to request the removal of personal data from Itecube's systems.

4. Compliance & Audit

Itecube may request an internal audit of the Customer's use of PipeCockpit to verify compliance with license terms. If unlicensed use is found, additional licenses must be purchased.

5. Copyright

All intellectual property rights in the Product/Service are owned by Itecube or its suppliers. No rights to content accessed via the Product/Service are granted to the Customer.

6. Updates

The software may periodically update automatically, which the Customer agrees to receive without additional notice.

7. Termination

Itecube may terminate the Customer's use of PipeCockpit if the terms of this EULA are violated. Upon termination, all copies of PipeCockpit must be deleted.

8. Warranty and Limitation of Liability

The Product/Service is provided "as is" without warranty. The Customer should test the application in a test environment before using it in a production environment. Itecube is not liable for any damages arising from the use or inability to use the Product/Service.

9. Dispute Resolution and Jurisdiction

Disputes will be resolved through arbitration in Paris, France, and will be governed by French law.

10. Entire Agreement

This EULA constitutes the entire agreement for the use of the Product/Service.

11. Support

For the paid version of the application, PipeCockpit, the Customer can request support from Itecube by emailing support@itecube.com.
